The ground rules for every mobile notary appointment we perform — what we can and cannot do, what we need from you, how fees work, and the limits of our responsibility.

01Acceptance of These Terms
These Terms & Conditions (the “Terms”) govern the notary and related services provided by Cross Town Notary Services (“we,” “us,” or “our”) to you (“Client” or “you”). By booking an appointment, submitting a request through this website, calling or texting us, or accepting services, you agree to these Terms.
If you are booking on behalf of a company, lender, title company, signing service, or another individual, you confirm you have authority to accept these Terms on their behalf and that they apply equally to that party.
02Scope of Services — We Are Notaries, Not Attorneys
Cross Town Notary Services is a mobile notary public commissioned by the State of California and a certified member of the National Notary Association. Our role is limited to verifying signer identity, administering oaths and acknowledgments where required, completing the notarial certificate, and recording the transaction in our journal as required by California law.
We are not attorneys licensed to practice law in California. We may not and will not draft legal documents, select forms for you, explain the contents or legal effect of a document, advise you on how to complete a document, or provide any legal, tax, immigration, or financial advice. If you need advice about your documents, please consult a licensed attorney or the appropriate professional before your appointment.
03Client Responsibilities
To complete a notarization lawfully, we rely on you to have everything ready at the time of the appointment:
- Every signer must be physically present at the appointment (unless a lawful remote or alternative method has been agreed to in advance).
- Every signer must present valid, unexpired, government-issued photo identification acceptable under California law.
- Documents must be complete — no blank spaces, missing pages, or missing notarial wording. We cannot choose or add certificate wording for you.
- Every signer must be aware of what they are signing, and must sign willingly and without coercion.
- The appointment location must be safe, accessible, and reasonably suited to signing (adequate lighting, a surface to write on, and no active hazards).
- Witnesses, if your document requires them, are your responsibility to arrange unless we have agreed in advance to help coordinate them.
04Right to Refuse or Stop a Notarization
California law requires us to decline a notarization in certain circumstances. We may refuse or discontinue service — at our sole discretion and without liability beyond any refund described below — if, for example: identification is missing, expired, or questionable; a signer appears confused, incapacitated, under duress, or unable to understand the transaction; a signer refuses to sign or to take a required oath; the document is incomplete or appears fraudulent; we are asked to perform an act that would be unlawful or outside our authority; or the environment is unsafe.
A refusal on these grounds is a legal obligation, not a service failure.
05Appointments, Mobile Service, and Travel
We travel to homes, offices, hospitals, care facilities, jails, coffee shops, and other agreed locations throughout Los Angeles County and surrounding areas. Appointment times are estimates: traffic, parking, facility check-in procedures, and prior appointments can affect arrival. We will communicate promptly if we are running behind.
Notarial fees are set by the State of California. Travel, trip, after-hours, wait-time, and convenience fees are separate from statutory notarial fees and are disclosed to you before service is performed. By proceeding with the appointment, you accept the quoted fees.
06Payment Terms
Unless we have agreed to invoiced or third-party billing in writing, payment is due at the time of service. Accepted payment methods will be confirmed when you book.
Travel and trip fees are earned once we travel to the agreed location, even if the notarization cannot be completed — for example, because a signer is absent, identification is unacceptable, a document is incomplete, or a signer declines to proceed. In those situations statutory notarial fees for acts not performed are not charged, but the travel or trip fee remains payable. Returned payments, chargebacks, or unpaid invoices may incur reasonable collection costs.
07Cancellations, Rescheduling, and No-Shows
We understand plans change. Please give us as much notice as possible — cancellations or reschedules made at least two hours before the scheduled time are free of charge.
If no signer is available within a reasonable waiting period after our arrival, or if the appointment is cancelled after we have already traveled to the location, the travel or trip fee applies. Extended waiting beyond the included window may be billed at our stated wait-time rate.
08Loan Signings, Apostille, and Third-Party Timelines
For loan signings, we act as the signing agent completing the notarizations and returning documents according to the instructions provided by the lender, title company, escrow, or signing service. We do not set loan terms, interpret loan documents, negotiate on your behalf, or guarantee funding, recording, or closing outcomes.
For apostille and authentication services, processing is performed by the California Secretary of State or another government authority. We prepare and submit documents and coordinate handling, but we do not control government processing times, courier delays, or the acceptance of a document by a receiving agency or foreign government. Quoted turnaround times are good-faith estimates only.
09Recordkeeping, Journal, and Confidentiality
California law requires us to maintain a sequential journal of notarial acts, which may include the date and type of act, the document type, signer name and signature, and the method of identification. This journal is our legal record and, where required by law or lawful request, it may be inspected or produced.
We treat the contents of your documents as confidential. We do not read documents beyond what is needed to identify the document type and complete the notarial certificate, and we do not copy, retain, or share document contents except as required by law or as instructed by you or your lender or title company.
10No Warranty on Documents or Outcomes
A notarization verifies the identity of the signer and the fact that the signature was made — it does not validate the legality, accuracy, completeness, or enforceability of the document itself. We make no representation or warranty that any document will be accepted by a court, bank, government agency, foreign authority, recorder, or other third party.
Services are provided “as is” to the fullest extent permitted by law, without warranties of any kind beyond the standards of care required of a California notary public.
11Limitation of Liability
To the maximum extent permitted by California law, our total liability arising out of or relating to our services — whether based in contract, tort, negligence, statute, or otherwise — is limited to the amount of fees you paid us for the specific appointment giving rise to the claim.
We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost business, delayed or failed closings, missed deadlines, rejected filings, penalties, or loss of opportunity. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability arising from our own willful misconduct or from statutory notary bond obligations.
12Indemnification
You agree to indemnify, defend, and hold harmless Cross Town Notary Services and its owner, employees, and contractors from any claims, damages, losses, penalties, or expenses (including reasonable attorneys’ fees) arising from information you provided that was inaccurate or fraudulent, from documents you asked us to notarize, from your or another signer’s acts or omissions, or from your breach of these Terms.
13Website Use and Communications
Content on this website is provided for general information only and is not legal advice. Submitting a form or requesting an appointment does not create an attorney-client relationship of any kind, and no confidential relationship is formed until service is agreed and performed.
By providing your phone number or email address, you consent to receive appointment-related calls, texts, and emails from us. Standard message and data rates may apply. You may opt out of non-essential messages at any time.
14Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or our services shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
15Changes to These Terms
We may update these Terms from time to time. The version posted on this page at the time you book governs your appointment, so please review it before each new engagement. The “Last updated” date above reflects the most recent revision.
